Terms of Service

You must be at least 18 years old, or using the Site under the supervision of a parent or guardian, to place an order. By placing an order you confirm that the information you provide (name, contact details, delivery address) is accurate and complete.

We make every reasonable effort to display our fragrances, pricing and descriptions accurately. However, we do not warrant that product descriptions, images or other content are entirely accurate, complete or error-free. Colours and scents may vary slightly from what’s depicted or described online.

All prices are listed in South African Rand (ZAR) and, where applicable, are inclusive of VAT. We reserve the right to change prices at any time without prior notice, though changes will never affect an order you’ve already placed and paid for.

In the unlikely event a product is listed at an incorrect price due to a typographical, pricing or technical error, we reserve the right to refuse or cancel any order placed at the incorrect price, whether or not the order has been confirmed. If you’ve already paid, you’ll receive a full refund.

When you place an order, you’re making an offer to purchase. We reserve the right to accept, refuse, limit or cancel any order at our discretion, for example where a product is out of stock, where we suspect fraud, or where an error has occurred. If we cancel an order you’ve paid for, you’ll receive a full refund.

Payment is processed securely by Payfast. We accept the payment methods Payfast makes available (including card, Instant EFT, and other supported methods). Your order is only confirmed once payment has been successfully received and verified.

We currently deliver within South Africa only. A flat delivery fee applies to every order, dispatched via The Courier Guy, with an estimated delivery window of 2–5 business days from dispatch. Delivery estimates are not guaranteed and may be affected by courier delays outside our control.

Risk in the goods (for example, loss or damage) passes to you once the order has been delivered to the address you provided. Please make sure your delivery address and contact details are correct at checkout. We’re not responsible for failed deliveries caused by incorrect or incomplete address information you supplied.

Because of the personal and hygiene-sensitive nature of fragrance products, we can only accept returns of items that are unopened, unused, and in their original sealed packaging, within 7 days of delivery. To start a return, contact us first using the details below, and please don’t send anything back before we’ve confirmed the return.

If you receive a faulty, damaged, or incorrect item, contact us within 7 days of delivery and we’ll replace it or refund you in full, including any delivery cost you paid, at no cost to you. This is in line with your rights under the Consumer Protection Act 68 of 2008.

Approved refunds are processed back to your original payment method via Payfast, and may take a few business days to reflect depending on your bank.

Wholesale, reseller and bulk orders are handled separately from our online retail checkout, typically quoted and confirmed via WhatsApp or direct enquiry. Pricing, minimum order quantities, and payment terms for wholesale orders are agreed individually and may differ from these Terms; where they do, the terms agreed directly with you for that order will apply.

You agree not to use the Site to:

• Break any applicable law or regulation
• Attempt to gain unauthorised access to any part of the Site, our systems, or other users’ information
• Interfere with or disrupt the Site’s security or functionality
• Place fraudulent orders or use another person’s payment details without authorisation
• Copy, scrape, or reproduce the Site’s content for commercial purposes without our permission

We reserve the right to refuse service or cancel orders from anyone we reasonably suspect of the above.

All content on the Site, including text, images, logos, and design, is owned by or licensed to Exotic Perfume and is protected by South African and international intellectual property law. You may not reproduce, distribute, or use our content commercially without our prior written consent.

The Site is provided “as is”. While we do our best to keep it accurate, secure and available, we don’t guarantee that it will be uninterrupted, error-free, or free of viruses or other harmful components.

To the maximum extent permitted by law, Exotic Perfume will not be liable for any indirect, incidental, or consequential loss or damage arising from your use of the Site or your purchase of a product, except where such liability cannot be excluded under the Consumer Protection Act or other South African law. Nothing in these Terms limits any right you have that cannot lawfully be excluded.

You agree to indemnify and hold Exotic Perfume harmless from any claim, loss, or damage (including reasonable legal costs) arising from your breach of these Terms or your misuse of the Site.

We won’t be responsible for any delay or failure to perform our obligations where that delay or failure results from events outside our reasonable control, including courier disruptions, load shedding, natural disasters, or other events of force majeure.

We may update these Terms from time to time to reflect changes in our business or the law. The “last updated” date at the top of this page will always show the most recent version. Continuing to use the Site after changes are posted means you accept the updated Terms.

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the South African courts, without prejudice to any right you have to refer a dispute to the National Consumer Commission or another applicable regulator.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to apply in full. These Terms, together with our Privacy Policy, make up the entire agreement between you and Exotic Perfume regarding your use of the Site.
